Privacy notice for data processing
Pursuant to Article 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter: GDPR), we inform you that:
In connection with the conclusion and performance of the Parking Space Rental Agreement, PARKING KRÓLEWSKI processes the personal data of the person concluding the Rental Agreement (the Parking User) and is the controller of such personal data. Personal data are also processed for accounting purposes (including issuing invoices), internal and external debt collection, enforcement proceedings, and the handling of complaints. PARKING KRÓLEWSKI may also process data for the justified purposes of the data controller, which in particular include direct marketing of products and services, statistical data analysis, and customer satisfaction surveys.
2. PARKING KRÓLEWSKI processes the following personal data: vehicle registration number, and in the case of complaints, debt collection and enforcement procedures, the following data are processed: first name, surname, residential address, PESEL number, e-mail address, phone number, registration number, vehicle make. Providing personal data is an obligation resulting from the Rental Agreement. Failure to provide data in the case of complaints, debt collection and enforcement procedures will result in such data being retrieved from public registers.
3. The recipients of data processed in connection with the conclusion and performance of the Parking Space Lease Agreement are debt collection companies, providers of e-mail services, parking and IT systems, as well as entities servicing these systems and the devices on which they are installed, banks, and – to the extent provided for by law – also entities to which PARKING KRÓLEWSKI is obliged to make such data available.
4. PARKING KRÓLEWSKI exercises due diligence to ensure that personal data is processed within the territory of the European Union, and in the event that it is transferred outside its territory, ensures that it is not used for purposes other than those for which it was collected and is stored in a manner that guarantees an adequate level of security.
Personal data will be stored for the duration of the Tenancy Agreement, and after its termination for the period required by law, in particular for the period resulting from accounting regulations and for the period ensuring that PARKING KRÓLEWSKI is able to establish and pursue claims related to the Tenancy Agreement.
6. Parking Królewski respects the rights of every individual regarding the processing of their personal data. In particular, every data subject has the right to:
a) obtaining information about the processing of her personal data,
(b) the right to access data, and to request that it be rectified, supplemented or amended,
(c) the right to erasure („the right to be forgotten”),
(d) the right to restrict the processing of data,
e) the right to data portability
(f) the right to object to the processing of her data for the legitimate purposes of PARKING KRÓLEWSKI as the data controller, including direct marketing of its products and services and profiling, as well as the right not to be subject to a decision based solely on automated processing.
7. PARKING KRÓLEWSKI fulfils the aforementioned rights by ensuring that an appropriate request can be submitted via email to the address biuro@parking.gda.pl, as well as in writing to the address PARKING KRÓLEWSKI marked with the reference „personal data”, with the proviso that:
– The data subject has the right to access their data and the right to information about that data; however, they may exercise this right no more than once every six months. More frequent exercise of the right to information and access to data will be subject to a fee of 50 zł, payable to PARKING KRÓLEWSKI’s bank account before PARKING KRÓLEWSKI processes the request. This fee represents the reasonable costs incurred by PARKING KRÓLEWSKI in connection with the exercise of the right of access and is permitted by law.
– the data subject has the right to request the erasure of their personal data, in particular when the data are no longer necessary for the purposes for which they were collected, and specifically for the performance of the Rental Agreement. However, PARKING KRÓLEWSKI is not obliged to erase the data if the processing is necessary for:
(a) the exercise of the rights to freedom of expression and information,
(b) compliance with a legal obligation to process under European Union or Polish law, or the performance of a task carried out in the public interest, in particular under the Accounting Act,
(c) for archiving purposes in the public interest, for scientific or historical research purposes, or for statistical purposes,
(d) to establish, pursue or defend legal claims.
– where the data subject objects to further processing for the purposes of marketing the company’s own products and services or profiling, PARKING KRÓLEWSKI will take such an objection into account, but will continue to process the data for the purposes of performing the Lease Agreement, fulfilling obligations under accounting regulations, handling complaints, and conducting internal and external debt recovery.
8. Parking Królewski informs that the person who has concluded the Parking Space Rental Agreement is not subject to decisions based solely on automated processing of personal data.
9. In relation to the processing of data by PARKING KRÓLEWSKI, the data subject has the right to lodge a complaint with the Inspector General for Personal Data Protection, and upon their appointment, with the Personal Data Protection Office.
To ensure the highest level of security for personal data processing operations, PARKING KRÓLEWSKI has appointed a Data Protection Officer, who can be contacted at biuro@parking.gda.pl, or alternatively in writing at the PARKING KRÓLEWSKI address.
11. Entry/access to this Parking area constitutes consent to the processing of personal data (image) within the meaning of the GDPR regulations for purposes related to the operation of CCTV surveillance, inter alia, to improve safety and enable state authorities to pursue claims of individual Users against others, as well as consent to the storage of CCTV recordings for a period of 30 days. The storage period may be extended in the event that the injured party, the police or a court request the securing and disclosure of copies thereof. Copies of CCTV recordings shall be disclosed exclusively to law enforcement authorities or a court. In such cases, the time for which they are stored in the relevant part shall be extended until the conclusion of the relevant proceedings.
CCTV footage is automatically destroyed (overwritten by subsequent recordings) on the recorder. The data controller for the video surveillance is PARKING KRÓLEWSKI, with its registered office in Gdańsk at ul. Bł. Ks. Franciszka Rogaczewskiego 55, and access to personal data is held by persons supervising the Parking operation system. Every recorded person has the right to access the saved data at the registered office of PARKING KRÓLEWSKI, subject to prior confirmation that data from the indicated location, date and time has been recorded and is still retained.
Data on parked cars will not be collected or used for marketing purposes. People entering the car park accept the data processing terms, and the regulations available at the entrance serve as their notification.
Cookies
I. Data collection
In accordance with the practice adopted by most websites, we store HTTP requests sent to our server. This means that we know the public IP addresses from which users browse the information content of our service. The resources browsed are identified by URL addresses. We also know:
– time of receipt of the enquiry,
– response dispatch time,
– the client station name – identification carried out via the HTTP protocol,
– information on errors that occurred during the execution of the HTTP transaction,
– URL of the page previously visited by the user (referrer link) – in the event that the visit to the Office's page occurred via a link,
– information about the user's browser.
These data are not associated with specific individuals browsing our website. To ensure the highest possible quality of service, we occasionally analyse log files in order to determine which pages are visited most frequently, what web browsers are used, whether the website structure contains errors, etc.
II. Use of data
The collected logs are stored indefinitely as auxiliary material used for administering the service. The information contained therein is not disclosed to anyone other than persons authorised to administer the server. Statistics helpful in administration may be generated on the basis of log files. Collective summaries in the form of such statistics do not contain any features identifying visitors to the service.
III. Cookie Mechanism
The website uses cookies. These are small text files sent by the web server and stored by the browser computer software. When the browser reconnects to the site, the website recognises the type of device the user is connecting from. The parameters allow the information contained in them to be read only by the server that created them. Cookies therefore facilitate the use of previously visited websites. The collected information relates to the IP address, type of browser used, language, operating system type, internet service provider, time and date information, location and information sent to the website via the contact form.
IV. Why we use cookies
The collected data is used to monitor and check how users use our websites in order to improve the functioning of the service, ensuring more efficient and seamless navigation. We monitor user information using the Google Analytics tool, which records user behaviour on the site. Cookies identify the user, which allows the content of the website they are using to be tailored to their needs. By remembering their preferences, it enables, for example, the appropriate matching of advertisements targeted at them. V. What cookies we use
Session cookies
These cookies are used to save session information. Web pages have no memory. Session cookies allow website owners to track users' movement from page to page, eliminating the need to provide the same information already given on a given page, and also for authentication purposes. Session cookies are deleted when the browser is closed.
Preference cookies
During the visit, cookies are used to save information about the type of browser used and the type of installed browser add-ons. They also save preferences selected when personalising the website, for example, preferred location, language or fonts. These preferences are remembered through the use of persistent cookies, so that during subsequent visits to the site, the user does not have to set them again.
Analytical cookies
These web analytics cookies allow a better understanding of how users interact with website content so that we can better organise our site layout. They collect information on how visitors use our site, the type of page from which users were redirected, and the number of visits and length of time users spend on the site. This information does not record specific personal data of the user, but is used to compile aggregated usage statistics for the site. For this purpose, we use the Google Analytics solution.
VI. Management of cookies
Users can at any time disable or restore the option of collecting cookies by changing the settings in their internet browser. Additional personal data, such as an e-mail address, is collected only in places where the user, by filling out a form, has explicitly consented to it.
